1. About these terms

These Terms and Conditions apply to all waste collection, clearance, transportation and disposal services supplied by Dunk the junk limited referred to in these terms as “we”, “us” or “the Company”.

The person or organisation ordering the service is referred to as “the Customer”.

By accepting our quotation, making a booking, signing this document or allowing the work to begin, the Customer confirms that they accept these Terms and Conditions.

2. Our services

We will collect and remove the waste described in the quotation, booking confirmation or waste collection form.

Unless agreed in writing, our service does not include:

• dismantling fixed structures;
• plumbing, electrical or gas disconnection;
• building or repair work;
• deep cleaning;
• removal of hazardous or prohibited waste;
• lifting items that cannot be moved safely; or
• work requiring specialist equipment or additional personnel.

Any additional work must be agreed before it is carried out and may result in an additional charge.

3. Quotations and estimates

Our quotation is based on the information, photographs, measurements and waste description supplied by the Customer.

Unless stated otherwise, quotations are estimates and may change where:

• the amount or weight of waste is greater than described;
• the waste is of a different type;
• hazardous or prohibited materials are discovered;
• access is restricted;
• additional labour, vehicles or equipment are required;
• waiting time is incurred;
• parking, congestion, permit or disposal charges apply; or
• the waste requires specialist handling or disposal.

We will inform the Customer of any additional charge before continuing wherever reasonably possible.

4. Customer responsibilities

The Customer confirms that:

1 they own the waste or have authority from the owner to arrange its removal;
2 the waste description supplied to us is complete and accurate;
3 all known hazardous materials have been declared before collection;
4 the waste has not been mixed, concealed or incorrectly described;
5 we will be given safe and reasonable access to the collection area;
6 any necessary parking permission, access code, loading permission or site authorisation has been arranged;
7 children, animals and unauthorised persons will be kept away from the working area; and
8 any items that must not be removed will be clearly identified before work begins.

The Customer must not ask our staff to remove property belonging to another person without that person’s authority.

5. Waste we do not normally accept

Unless we have agreed otherwise in writing, we do not collect:

• asbestos or suspected asbestos;
• clinical, infectious or medical waste;
• chemicals, solvents, acids or pesticides;
• oils, fuels or unidentified liquids;
• gas cylinders or pressurised containers;
• explosives, ammunition or fireworks;
• radioactive materials;
• human or animal remains;
• contaminated soil;
• loose sharp objects;
• fridges, freezers, air-conditioning equipment or other items requiring specialist treatment;
• batteries, fluorescent tubes, paint or electrical equipment where specialist handling is required; or
• any material that we are not licensed, permitted or insured to carry.

If prohibited or undeclared waste is discovered, we may refuse to collect it, stop the work and charge for work already completed, attendance, waiting time and any costs reasonably incurred.

6. Hazardous waste

Hazardous waste will only be collected where:

• it has been declared in advance;
• we have confirmed that we can legally accept and transport it;
• the waste is properly contained, packaged and labelled;
• the required documentation has been completed; and
• the Customer accepts any additional collection, administration and disposal charges.

We may refuse any hazardous waste that differs from the description provided or cannot be handled safely and lawfully.

7. Access and site conditions

The Customer must provide suitable access for our employees, contractors and vehicles.

The Customer must tell us about any known risks, including:

• weak floors;
• hidden pipes or cables;
• unsafe staircases;
• restricted entrances;
• low ceilings;
• contaminated areas;
• fragile surfaces;
• parking restrictions; and
• any other health and safety risk.

We may suspend or refuse work where we reasonably believe that conditions are unsafe or unlawful.

Additional charges may apply where waste must be carried an unreasonable distance, moved through difficult access routes or taken from upper floors without a suitable lift.

8. Parking, permits and additional charges

The Customer is responsible for providing lawful parking or informing us of parking restrictions before the booking.

Unless included in the quotation, the Customer must reimburse reasonable costs for:

• parking;
• permits;
• tolls;
• congestion or clean-air-zone charges;
• waiting time;
• additional disposal charges; and
• penalties caused by incorrect parking or access instructions supplied by the Customer.

We remain responsible for penalties caused solely by our own unlawful actions.

9. Collection dates and arrival times

Collection dates and arrival times are estimates unless we specifically confirm a fixed appointment in writing.

We will take reasonable steps to arrive within the agreed period, but delays may occur because of traffic, weather, vehicle problems, disposal-site restrictions or other circumstances outside our reasonable control.

We are not responsible for losses caused solely by a reasonable delay, although we will inform the Customer where practicable.

10. Cancellations and failed collections

The Customer may cancel or rearrange a booking by contacting us at
Info@dunkthejunk.co.uk

Our cancellation charges are:

• Free more than 48 hours before collection: no charge/full refund
• between 24 and 48 hours before collection: 10% of agreed price
• less than 24 hours before collection: 50% of agreed price
• after our team has been dispatched or has arrived: 100% of agreed price

A failed collection or call-out charge may apply where:

• nobody is available to provide access;
• the waste is not ready;
• the collection address is incorrect;
• safe access is unavailable;
• required permits have not been arranged; or
• the waste contains undeclared or prohibited materials.

Any cancellation charge will reflect the costs and losses reasonably incurred by us.

11. Consumer cancellation rights

Where the Customer is an individual acting for purposes mainly outside their business and books the service online, by telephone or away from our business premises, statutory cancellation rights may apply.

Where the Customer asks us to begin work during the statutory cancellation period, the Customer expressly requests early performance of the service and agrees to pay for work completed before cancellation.

Where the service has been fully performed following the Customer’s express request and acknowledgement, the statutory right to cancel may no longer apply.

Nothing in these terms removes any legal rights that cannot lawfully be excluded.

12. Payment

The price and payment terms will be shown on the quotation, booking confirmation or invoice.

Unless otherwise agreed in writing:

• payment is due when agreed before collection/immediately after collection/within 14 days of invoice];
• payment must be made by [bank transfer/card/approved payment method];
• quoted prices are [inclusive/exclusive] of VAT;
• ownership of reusable items does not transfer to us until payment has been made; and
• the Customer must pay all undisputed amounts by the due date.

For business customers, we may charge statutory interest and reasonable recovery costs on overdue payments where permitted by law.

13. Waste transfer documentation

The Customer agrees to provide all information reasonably required to complete the appropriate waste documentation, including:

• the Customer’s name and address;
• the collection address;
• the date and time of transfer;
• an accurate description of the waste;
• the quantity or estimated weight;
• the relevant waste classification or code;
• the Customer’s business activity or SIC code where required; and
• confirmation of how the waste is contained.

The Customer must check the information before signing the relevant document.

We will provide or complete a Waste Transfer Note, hazardous waste consignment note or other legally acceptable document where required.

14. Disposal and recycling

We will transport waste only to a facility or person authorised to receive it.

We may sort, reuse, recycle, recover, treat or dispose of collected materials in accordance with applicable law and the facilities available to us.

Once collected and accepted by us, waste may be combined with compatible waste from other customers unless separate handling has been agreed.

15. Items with possible value

Unless agreed before collection, all items identified for removal will be treated as waste.

The Customer is responsible for checking the collection area and removing:

• money;
• jewellery;
• confidential documents;
• personal information;
• keys;
• electronic devices;
• sentimental items; and
• any property that the Customer wishes to keep.

We are not responsible for the removal of an item that was placed with the waste or was not clearly identified as an item to be retained.

Where we agree to purchase, credit or offset the value of an item, the agreement must be recorded separately in writing.

16. Damage and liability

We will carry out the service with reasonable care and skill.

The Customer must notify our team immediately of any visible damage and confirm the complaint in writing within [seven] days.

We are not responsible for damage caused by:

• pre-existing defects;
• weak, unstable or defective structures;
• undisclosed hazards;
• normal movement of bulky items through restricted access;
• the Customer’s instructions against our reasonable advice; or
• events outside our reasonable control.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.

For business customers only, and where legally permitted, our total liability arising from the service will not exceed [the total price paid for the affected service/£amount], except where a different limitation is required by law.

17. Photographs and records

We may take photographs of the waste, access route and collection area before, during and after the work for:

• quotation purposes;
• operational records;
• proof of collection;
• waste classification;
• health and safety;
• staff training; and
• resolving complaints or disputes.

We will not use identifiable photographs for advertising without appropriate permission.

18. Complaints

Complaints should be sent to:

Email: info@dunkthejunk.co.uk
Address: Victoria House, 12 Hatherley Road, Sidcup, Kent, DA14 4DT
Telephone: 02039166266

The Customer should provide the booking or invoice number, collection date, address and details of the complaint.

We aim to acknowledge complaints within [five] working days and provide a full response within [fourteen] working days.

We will use personal information to:

• manage bookings;
• provide quotations;
• perform collections;
• issue invoices and waste documentation;
• process payments;
• communicate with the Customer;
• meet legal and regulatory obligations; and
• deal with complaints.

Further information is available in our Privacy Notice at www.dunkthejunk.co.uk

20. Events outside our control

We will not be responsible for failure or delay caused by events outside our reasonable control, including severe weather, road closures, accidents, vehicle breakdowns, strikes, public emergencies, disposal-site closures or changes in law.

We will contact the Customer as soon as reasonably practicable and arrange a new collection date where appropriate.

21. Changes to these terms

Any change to an individual booking must be agreed in writing.

We may update these general Terms and Conditions from time to time. The version accepted when the booking is confirmed will apply to that booking.

22. Severability

If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.

23. Governing law

These terms are governed by the laws of England and Wales.

Where the Customer is a consumer, they retain any right to bring proceedings in the courts applicable to their place of residence.

Where the Customer is acting in the course of business, the courts of England and Wales will have exclusive jurisdiction, unless otherwise agreed in writing.
